Terms of Service
These general terms and conditions regulate the legal relationship between you as a customer and Jasmin Böhm.
1. REGISTRATION AND CONFIRMATION
With the registration, which can be made in writing, verbally or by telephone, the customer offers Jasmin Böhm the conclusion of a binding contract. The contract is concluded with the acceptance/confirmation by Florian Forster and the transfer of the 50% down payment per person of the retreat amount (abbreviated: amount) up to 14 days after the confirmation, which does not require a specific form. In the case of a registration for several participants, the applicant is liable for their contractual obligations as for his own, unless he has expressly and separately declared this. The customer agrees to the storage of his data.
2. PAYMENT
A deposit of 50% of the total amount of the retreat per participant must be paid upon conclusion of the contract. The payment of the deposit is to be transferred within 14 days after conclusion of the contract. The remaining amount has to be paid 14 days before departure. If the down payment due is not paid by 21 days after conclusion of the contract or the remaining amount by 14 days before departure, Florian Forster will be released from the service and can demand the corresponding cancellation costs from the customer if he did not have a right to refuse payment. The payment can be processed as a transfer to the bank account named by Florian Forster.
3. SERVICES
The scope of the contractually agreed services of the retreat advertised on the website (www.explore-yourself-events.com) results from the service description. However, Florian Forster expressly reserves the right to declare a change in the program details before the contract is concluded for objectively justified, significant and unforeseeable reasons, about which the customer will of course be informed before booking.
5. WITHDRAWAL AND CANCELLATION POLICY
The customer can withdraw from the contract at any time before the start of the journey. The decisive factor is the receipt of the written declaration of withdrawal by Florian Forster. If the customer withdraws from the contract or if he does not attend the retreat without withdrawing from the contract, Florian Forster can demand appropriate compensation from the customer. Florian Forster is entitled to a replacement regardless of the reasons that caused the customer to withdraw.
Florian Forster can calculate this entitlement according to his choice or, taking into account the following structure, according to the proximity of the time of withdrawal to the contractually agreed start of the yoga and energy retreat, he can calculate a flat rate as a percentage of the yoga and energy retreat price.
In the event of cancellation, the following cancellation fees apply to all booked services:
• If you cancel up to 2 months before the date, 25% of the total amount of all booked services will be due.
• If you cancel 2 months to 3 weeks before the date, 50% of the total amount of all booked services will be due.
• In the event of cancellation from 3 weeks to 1 day before the date, 100% of the total amount of all booked services will be due.
Instead of withdrawing, the customer can provide a replacement person. Jasmin Böhm reserves the right to reject this person if their inclusion is not possible for organizational reasons.
If the customer ends the retreat prematurely for compelling reasons, the customer is not entitled to a pro rata refund.
6. WITHDRAWAL AND TERMINATION BY THE ORGANIZER
Jasmin Böhm can withdraw from the contract up to 14 days before the retreat if the minimum number of 12 participants for the retreat has not been reached. The customer receives the paid course price back immediately. The customer is not entitled to any further claims.
Jasmin Böhm is entitled to withdraw from the contract for important reasons, in particular if force majeure or other circumstances for which Jasmin Böhm is not responsible make it impossible to fulfill the contract. In this case, Jasmin Böhm will reimburse in full all fees that may have already been paid up to that point. A claim for damages by the customer against Jasmin Böhm does not arise from this.
Jasmin Böhm can terminate without notice if the customer disrupts the implementation of the retreat despite a warning from Jasmin Böhm or if he behaves in breach of contract to such an extent that the immediate cancellation (termination without notice) of the organizer is justified.
7. COVID-19
In the event that the retreat cannot be carried out due to Covid-19 infection control measures imposed by the federal or state government, the amount paid by the customer will be fully refunded.
8. OTHER
All other agreements in addition to this contract must be in writing. The invalidity of individual provisions of this contract does not result in the invalidity of the entire contract.
The customer can only sue Jasmin Böhm at his registered office. The place of residence of the customer is decisive for claims by Jasmin Böhm against the customer, unless the claim is directed against registered traders or persons who have moved their place of residence or usual place of residence abroad after the conclusion of the contract, or whose place of residence or usual place of residence is in The time when the lawsuit was filed is not known. In these cases, the seat of the holiday organizer is decisive. The invalidity of individual provisions of the vacation contract does not result in the invalidity of the entire vacation contract.
